Here's what I know.

I gave up on the first lawyer I tried to contact and got a hold of another. He told us that as a general rule you don't get unemployment if you quit or resign. However if it's a forced resignation you may be able to get benefits. So I called the state unemployment office and my husband talked to one of their reps. She told him that if it's forced he can indeed draw benefits. She said to make it clear in the resignation letter that he's not doing it because he wants to but that he's doing because he's being forced to. She said if they decide to fight paying him benefits the burden is on them to prove some sort of gross misconduct on his part. Which if there was some sort of gross misconduct they wouldn't have had him at work this last week. I feel better about that.

The lawyer also said he should call HR and make sure that the promise to give him the bonus money he earned for the fourth quarter was indeed coming to him. The said he would indeed get that money. Get this! The Regional boss called him and wanted to know why he was checking up on him! He wanted to know why CCB didn't believe him when he said we'd get that money. HELLO! How can he fault us for making sure we have things covered?! He didn't do it because he wanted to. He did it because his wife was freaking out and trying to figure out how we are going to get from this side of this mess to the other!

Another head hunter has been all over CCB since before Christmas. There is good and bad in their preliminary talks. I'm thankful for all your encouragement. It has been very uplifting to find that maybe we had more friends here than we thought we did. I know when this is all said and done we will be stronger and better off. It's just the process that is scary!

I'm SO glad you spoke to some knowledgeable people!! And CCB can tell his big boss to go eff himself, I mean, sorry he isn't going to lay down and not get paid. It's a dog eat dog world out there and everyone needs to look out for themselves. There is no harm in CCB making sure he is getting what's coming to him. Good luck you guys! Keep us posted...

Yay for talking to an attorney who knows stuff! And I'm glad he's contacted HR and the unemployment office. It's good to cover your bases and know you're going to get the money he deserves. This is so crazy... I'm sure you guys are totally stressed out! Good luck!

It sounds like you are getting some good advice....Make sure you document everything that is going on....Use a notebook and write down everything you do so you have notes if you ending up suing or need it to get your unemployment or bonus....Write, names, phone numbers and etc....This is important.
